The litigation and enforcement statistics for 2015 all show that wage and hour class and collective actions remained the #1 source of legal exposure for companies. The number of wage and hour lawsuits filed during 2015 reached an all-time high, and the value of wage and hour related settlements increased. All signs suggest that 2016 will be another record-breaking year for wage and hour claims. This reality, coupled with the Department of Labor’s anticipated changes to the tests for white collar exemptions and recent Administrator’s Interpretations on independent contractors and joint employment, requires that employers be even more proactive in evaluating their practices and mitigating wage and hour risks to avoid becoming a 2016 litigation statistic.
