Necessity of Expert Report at Issue in High Court Case

While reviewing a case against a doctor of an allegation of sexual assault, the Texas Supreme Court considered whether it was, instead, a health care liability claim which then would require an expert report. If the court decides that patients who allege sexual assault do not need to file expert reports, defendants lawyer Holly Williamson tells Texas Lawyer, "Plaintiffs would then re-characterize their claims not as medical-malpractice claims but as assault claims; therefore, they’ll be able to bypass the caps on damages, and they will avoid the necessities of medical experts."
