Kenyon Proves Successful for Sony Electronics

New York, September 10, 2013 - Kenyon successfully represented client Sony Electronics in a patent litigation in the Northern District of California brought by MedioStream. Originally filed in the Eastern District of Texas, Sony and other defendants filed a writ of mandamus with the Federal Court which granted the petition and ordered the judge to transfer the case. Mediostream attempted to obtain a reversal of the Federal Court’s order but was unsuccessful. The litigation subsequently grew into multiple cases in the Northern District of California, including a third MedioStream patent and allegations of trade secret misappropriation against Sony.

Kenyon successfully obtained a dismissal of the trade secret complaint with prejudice and in the late stages of the patent case, Kenyon filed and argued a motion for summary judgment of invalidity based on Sony’s own prior art software product. After Kenyon’s pending motion for summary judgment, the court’s comments at oral argument, and pending reexaminations, MedioStream settled all pending matters. The settlement concludes six years of litigation.
