Kenyon Successfully Defends Client Sony Electronics Against Allegations of Patent Infringement

New York, February 5, 2013 – On behalf of client Sony Electronics, Inc., Kenyon & Kenyon LLP successfully quashed a subpoena brought by plaintiff Achates Reference Publishing, Inc. Achates subpoenaed nonparty Sony as part of Achates Reference Publishing, Inc. v. Symantec Corporation et al., a pending case in which Achates has accused a number of electronics companies of infringing two separate patents. Both patents describe methods for authenticating and activating software that distributes information to products without many of the costs and restrictions normally associated with these techniques. Kenyon argued that the subpoena was invalid on its face and that Achates was wrong not to withdraw when notified of the defect. Judge Payne of the Eastern District of Texas agreed that “Achates did not have just cause to oppose Sony Electronics’ motion,” quashing the subpoena and awarding attorney’s fees. Judge Payne also commended Kenyon for “conducting this matter in a highly professional manner.”
