Lisa Sotto speaks to Law360 regarding upcoming privacy and cybersecurity cases to watch in the second half of 2019. An upcoming ruling by the European Union’s Court of Justice theoretically could bring commerce between the US and Europe “to a grinding halt,” she says. “Data won’t be able to move between the EU and….countries like the US, and it’ll be impossible to conduct business.” Both the Standard Contractual Clauses and the Privacy Shield, which have ensured that much personal data flows freely from the EU, are under attack in the court. An advisory opinion is expected in three to six months, with a final ruling shortly afterwards. In another case, Sotto warns Law360 that Illinois’ Biometric Information Privacy Act is likely to be subject to “a very significant amount of litigation.” Some of the friction will depend on whether attorneys general in Texas and Washington begin enforcing the biometric privacy laws in their own states, she explains.
