Attorney-Client Privilege Protection Act may limit executive branch investigations

In February 2009, the Department of Justice’s decade-long waffling over its policy on the waiver of attorney-client privilege in corporate investigations was moved back to Congress by Sen. Arlen Specter, the senior minority member of the Senate Judiciary Committee. Sam Danon, a litigation partner in the firm’s Miami office, pointed out that the Specter bill will cover everyone while DOJ policy doesn’t reach other federal agencies that have similar policies. Danon’s practice focuses on litigation with an emphasis on financial institutions and government regulatory advice, internal investigations, corporate compliance, petroleum marketing, business torts, contract and partnership disputes, products liability and intellectual property.
