On November 1, 2023, 29 nations, including the U.S., the UK, the EU and China (full list available here), reached a ground-breaking agreement, known as the Bletchley Declaration. The Declaration sets forth a shared understanding of the opportunities and risks posed by AI and the need for governments to work together to meet the most significant challenges posed by the technology. The Declaration states that there is an urgent need to understand and collectively manage the potential risks posed by AI to ensure the technology is developed and deployed in a safe, responsible way. On August 5, 2020, the French Data Protection Authority (the “CNIL”) announced that it has levied a fine of €250,000 on French online shoe retailer, Spartoo, for various infringements of the EU General Data Protection Regulation (“GDPR”). This is the first penalty under the GDPR enforced by the CNIL as the lead supervisory authority (“Lead SA”) in cooperation with other EU supervisory authorities (“SAs”).
On June 19, 2020, France’s Highest Administrative Court (the “Conseil d’Etat”) issued a decision partially annulling the guidelines of the French Data Protection Authority (the “CNIL”) on cookies and similar technologies (the “Guidelines”). The Conseil d’Etat annulled the provision of the Guidelines imposing a general and absolute ban on ‘cookie walls’ that prevent users who do not consent to the use of cookies from accessing a site or mobile app. However, the Conseil d’Etat upheld the main part of the Guidelines. On the day of the Conseil d’Etat’s decision, the CNIL published a statement (the “Statement”) announcing that they took note of the decision and will strictly comply with it.
On June 19, 2020, France’s Highest Administrative Court (“Conseil d’Etat”) upheld the decision of the French Data Protection Authority (the “CNIL”) to impose a €50 million fine on Google LLC (“Google”) under the EU General Data Protection Regulation (the “GDPR”) for its alleged failure to (1) provide notice in an easily accessible form, using clear and plain language, when users configure their Android mobile devices and create Google accounts, and (2) obtain users’ valid consent to process their personal data for ad personalization purposes. Google had appealed this decision before the Conseil d’Etat. Because the Conseil d’Etat hears cases on appeal from the CNIL in both the first and last instances, the CNIL’s fine is now final. This fine against Google was the first fine imposed by the CNIL under the GDPR and is the highest fine imposed by an EU supervisory authority under the GDPR to date.

On May 7, 2020, the French Data Protection Authority (the “CNIL”) updated its previous guidance for employers relating to the processing of employee and visitor personal data in the context of the COVID-19 outbreak, in particular, in the context of lifting containment measures (the “Updated Guidance”). Some employers may consider implementing systematic body temperature checks at the entrance to their premises. Similarly, employers may wish to assess employees’ exposure to the virus or their health statuses when they return to work. On March 17, 2020, the Executive Committee of the Global Privacy Assembly (“GPA”) issued a statement giving their support to the sharing of personal data by organizations and governments for the purposes of fighting the spread of the COVID-19 pandemic. The GPA brings together data protection regulators from over 80 countries and its membership currently consists of more than 130 data protection regulators around the world, including the UK Information Commissioner’s Office, the U.S. Federal Trade Commission, and the data protection regulators for all EU Member States.

On November 26, 2019, the French Data Protection Authority (the “CNIL”) announced that it had levied a fine of €500,000 on Futura Internationale, a French SME specializing in thermal insulation of private buildings, for various infringements of the EU General Data Protection Regulation (“GDPR”). The infringements related to the company’s direct marketing voice-to-voice calls include failure to (1) comply with the individuals’ objection to the processing of their personal data for direct marketing; (2) process only relevant personal data (by recording excessive comments in the CRM software); (3) provide sufficient notice regarding the recording of phone calls and data processing; (4) cooperate with the CNIL; and (5) implement appropriate data transfer mechanisms for the data transfers to non-EU call center providers.
On October 22, 2019, the French Data Protection Authority (the “CNIL”) published a list of processing operations (in French) that it considers not requiring a data protection impact assessment (“DPIA”). On September 24, 2019, the Court of Justice of the European Union (the “CJEU”) released its judgments in cases C-507/17, Google v. CNIL and C-136/17, G.C. and Others v. CNIL regarding (1) the territorial scope of the right to be forgotten, referred to in the judgement as the “right to de-referencing,” and (2) the conditions in which individuals may exercise the right to be forgotten in relation to links to web pages containing sensitive data. The Court’s analysis considered both the EU Data Protection Directive and the EU General Data Protection Regulation (“GDPR”).
On September 10, 2019, the French data protection authority (the “CNIL”) updated its existing set of questions and answers (“FAQs”) on the impact of a no-deal Brexit on data transfers from the EU to the UK and how controllers should prepare.
On July 25, 2019, the French Data Protection Authority (the “CNIL”) published new template records of data processing activities pursuant to Article 30 of the EU General Data Protection Regulation (“GDPR”). This provision requires organizations subject to the GDPR to maintain internal records of data processing activities. The CNIL recalled that such records are a key accountability tool under the GDPR for identifying, understanding and controlling data processing activities. Setting up and maintaining these records provide businesses with the opportunity to ask the right questions and limit privacy risks under the GDPR. On July 18, 2019, the French Data Protection Authority (the “CNIL”) published new guidelines on cookies and similar technologies (the “Guidelines”). As announced by the CNIL in its action plan on targeted advertising for 2019-2020, its 2013 cookie guidance is no longer valid in light of the strengthened consent requirements of the EU General Data Protection Regulation (“GDPR”). The Guidelines therefore repeal the CNIL’s 2013 recommendations on cookies and reconceive the rules applicable to the use of cookies and similar technologies in France, as they take shape from (1) the provisions of the EU ePrivacy Directive as implemented under French law, and (2) the GDPR consent requirements.

On March 5, 2019, the Global Privacy Enforcement Network (“GPEN”), a global network of more than 60 data protection authorities (“DPAs”) around the world, published the results of its 2018 intelligence gathering operation on organizations’ data privacy accountability practices (the “Sweep”). On July 19, 2018, the French Data Protection Authority (“CNIL”) announced that it served a formal notice to two advertising startups headquartered in France, FIDZUP and TEEMO. Both companies collect personal data from mobile phones via software development kit (“SDK”) tools integrated into the code of their partners’ mobile apps—even when the apps are not in use—and process the data to conduct marketing campaigns on mobile phones.
On December 18, 2017, the French data protection authority (“CNIL”) publicly announced that it served a formal notice to WhatsApp regarding the sharing of WhatsApp users’ data with Facebook Inc. (“Facebook”). This decision, dated November 27, 2017, follows the CNIL’s investigations regarding Facebook’s 2014 acquisition of WhatsApp. In 2016, WhatsApp updated its Terms of Service and Privacy Policy to reflect the sharing of information with Facebook. Following this update, the Article 29 Working Party (“Working Party”) requested explanations from WhatsApp on its data processing practices and data sharing, and asked the company to stop sharing data for targeted advertising purposes. The Working Party also gave a mandate to its subgroup in charge of the cooperation on investigations and sanctions to coordinate actions of the relevant national data protection authorities. It is in that context that the CNIL started its investigation of WhatsApp’s data processing practices.
On October 17, 2017, the French Data Protection Authority (“CNIL”), after a consultation with multiple industry participants that was launched on March 23, 2016, published its compliance pack on connected vehicles (the “Pack”) in line with its report of October 3, 2016. The Pack applies to connected vehicles for private use only (not to Intelligent Transport Systems), and describes the main principles data controllers must adhere to under both the current French legislation and the EU General Data Protection Regulation (“GDPR”).
The Centre for Information Policy Leadership at Hunton & Williams LLP (“CIPL”) recently submitted responses to the Irish Data Protection Commissioner (IDPC Response) and the CNIL (CNIL Response) on their public consultations, seeking views on transparency and international data transfers under the EU General Data Protection Regulation (“GDPR”).
The responses address a variety of questions posed by both data protection authorities (“DPAs”) and aim to provide insight on and highlight issues surrounding transparency and international transfers.
On September 29, 2017 the French Data Protection Authority (CNIL) published a guide for data processors to implement the new obligations set by the EU General Data Protection Regulation (“GDPR”). The guidance addresses the extended scope of the GDPR and the new and direct obligations data processors will have when the GDPR comes into force on May 25, 2018. The guidance elaborates a three-step checklist for data processors:
On September 20, 2017, the French Data Protection Authority (CNIL) announced that it has updated two standards on privacy seals in order to take into account the requirements of the EU General Data Protection Regulation (“GDPR”).
Recently, the fourth edition of the book, The International Comparative Legal Guide to: Data Protection 2017, was published by the Global Legal Group. Hunton & Williams’ Global Privacy and Cybersecurity lawyers prepared several chapters in the guide, including the opening chapter on “All Change for Data Protection: The European Data Protection Regulation,” co-authored by London partner Bridget Treacy and associate Anita Bapat. On July 25, 2017, the French Data Protection Authority (“CNIL”) published their decision on the adoption of several amendments to its Single Authorization AU-004 regarding the processing of personal data in the context of whistleblowing schemes (the “Single Authorization”). The amendments reflect changes introduced by French law on December 9, 2016, regarding transparency, the fight against corruption and the modernization of the economy, also known as the “Sapin II Law.”
On July 27, 2017, the French Data Protection Authority (“CNIL”) imposed a fine of €40,000 on a French affiliate of the rental car company, The Hertz Corporation, for failure to ensure the security of website users’ personal data.
On March 28, 2017, the French Data Protection Authority (“CNIL”) published its Annual Activity Report for 2016 (the “Report”) and released its annual inspection program for 2017.
On March 15, 2017, the French data protection authority (the “CNIL”) published a six step methodology and tools for businesses to prepare for the EU General Data Protection Regulation (“GDPR”) that will become applicable on May 25, 2018.
On February 23, 2017, the French Data Protection Authority (“CNIL”) launched an online public consultation on three topics identified by the Article 29 Working Party (“Working Party”) in its 2017 action plan for the implementation of the EU General Data Protection Regulation (“GDPR”). The three topics are consent, profiling and data breach notification.
On November 19, 2016, the French government enacted a bill creating a legal basis for class actions against data controllers and processors resulting from data protection violations. The bill, which aims to facilitate access to justice for French citizens, establishes a general class action regime and includes specific provisions regarding data protection violations. These provisions go beyond the class action provisions already in place for consumers by adding, within the context of the French Data Protection Act of 1978 (“Loi Informatique et Libertés”), a right to class actions for data protection violations regardless of industry sector.
On October 7, 2016, the French Digital Republic Bill (the “Bill”) was enacted after a final vote from the Senate. The Bill aligns the French legal data protection framework with the EU General Data Protection Regulation (“GDPR”) requirements before the GDPR becomes applicable in May 2018.
On October 3, 2016, at the Paris Motor Show, the French Data Protection Authority ("CNIL") reported on the progress of a new compliance pack on connected vehicles. The work was launched on March 23, 2016, and should be finalized in Spring 2017.
On September 27, 2016, the French Data Protection Authority (“CNIL”) announced the adoption of two new decisions, Single Authorizations AU-052 and AU-053, that will now cover all biometric access control systems in the workplace. These two new decisions repeal and replace the previous biometric decisions adopted by the CNIL and lay down the CNIL’s new position on biometric systems used to control access to the premises, software applications and/or devices in the workplace.
On September 23, 2016, the French Data Protection Authority ("CNIL") published the results of the Internet sweep on connected devices. The sweep was conducted in May 2016 to assess the quality of the information provided to users of connected devices, the level of security of the data flows and the degree of user empowerment (e.g., user’s consent and ability to exercise data protection rights).
On July 20, 2016, the French Data Protection Authority (“CNIL”) announced that it issued a formal notice to Microsoft Corporation (“Microsoft”) about Windows 10, ordering Microsoft to comply with the French Data Protection Act within three months.
Background
Following the launch of Microsoft’s new operation system, Windows 10, in July 2015, the CNIL was alerted by the media and political parties that Microsoft could collect excessive personal data via Windows 10. A group composed of several EU data protection authorities was created within the Article 29 Working Party to examine the issue and conduct investigations in their relevant EU Member States. The CNIL initiated its investigation and carried out seven online inspections in April and June 2016. The CNIL also questioned Microsoft on certain points of its privacy statement.
On June 30, 2016, a joint committee composed of representatives from both chambers of the French Parliament (“Joint Committee”) reached a common position on the French ‘Digital Republic’ Bill that rejects the data localization amendment previously approved by the French Senate, but significantly amends other aspects of the French Data Protection Act.

On April 12, 2016, the French Data Protection Authority (“CNIL”) announced that it will participate in a coordinated online audit to analyze the impact of everyday connected devices on privacy. The audit will be coordinated by the Global Privacy Enforcement Network (“GPEN”), a global network of approximately 50 data protection authorities (“DPAs”) from around the world.
On March 23, 2016, the Chairwoman of the French Data Protection Authority (“CNIL”) opened proceedings that will lead to the release of a compliance pack on connected vehicles.
The CNIL announced that the compliance pack will contain guidelines regarding the responsible use of personal data for the next generation of vehicles. It will assist various stakeholders in the industry prepare for the General Data Protection Regulation.
On February 19, 2016, the French Data Protection Authority (“CNIL”) made public its new Single Authorization Decision No. 46 (“Single Authorization AU-46”). This decision relates to the data processing activities of public and private organizations with respect to the preparation, exercise and follow-up regarding disciplinary or court actions, and the enforcement of those actions.
On November 19, 2015, the French Data Protection Authority (“CNIL”) published guidance, including a set of frequently asked questions, to assist companies that are transferring personal data to the U.S. pursuant to the Safe Harbor framework.
On November 13, 2015, the French Data Protection Authority (“CNIL”) announced its decision in a case against Optical Center, imposing a fine of €50,000 on the company for violations related to the security and confidentiality of its customers’ personal data.
On September 2, 2015, the French Data Protection Authority (“CNIL”) published the results of an Internet sweep of 54 websites visited by children and teenagers. The sweep was conducted in May 2015 to assess whether websites that are directed toward, frequently used by or popular among children comply with French data protection law. As we previously reported, the sweep was coordinated by the Global Privacy Enforcement Network (“GPEN”), a global network of approximately 50 data protection authorities (“DPAs”). The CNIL and 28 other DPAs that are members of the GPEN participated in the coordinated online audit. A total of 1,494 websites and apps were audited around the world.
